As an international student you will have the same rights as American citizens regarding personal safety and should contact law enforcement if you experience a threatening situation. What Crime Has Been Comitted Essay The purpose of this report is to sum up the court case of Rixon Vs Star City PTY LTD (2001 september). Mr Brian Rixon is the Appellant and Star City Pty Ltd (formerly Sydney Harbour Casino Pty Ltd) is the Respondent. Mr Rixon is suing Star City for battery, assult and unlawful arrest. What crime has beem commited? Include a defention of this crime. In this particulular case of Brian Rixon vs Star City PTY LTD, battery, assult and unlawful arrest were alegedely commited, these offences fall under tort law. A tort can be defined as a civil wrong. Battery can be defined as; direct intentional or neglective conduct that causes contact with the body of another without consent. While in criminal law this conduct is also known as assault, in civil actions a distinction is made between battery that invoves a threat of contact without assault. Brian Rixon had been made the subject of an exclusion order issued under the Casino Control Act (which meant that he could not return to the casino). However Mr Rixon did not abide to these terms and once again entered the casino. As a result of this an employee of the respondent approached Mr Rixon in the casino, placed his hand on Mr Rixon, spun him around informed him that; as an excluded person, he was required to follow him to an interview room. Mr Rixon was held in this room for approximately an hour and a half before police arrived; during which time he claimed he suffered stress and anxiety. Indentify the defenda nts and what plea they used. The defendants in this particular case are Star City PTY LTD. They had decided to plea not guilty and defended there employes decision to remove Mr Rixon from the casino as he was violating the casino control act. Outline the arguments they used in there case The defendants used the following arguments in there defence: Defence against assualt- Proof of assault requires proof of an intention to create in another person an apprehension of imminent harmful or offensive contact. If the assault lies in creating an apprehension of impending contact, proof of the assault does not require proof of an intention to follow it up or carry it through. However Mr Ross (Casino Inspector) placed his hand on Mr Rixons shoulder without using any degree of force and said Are you Brian Rixon? which leads to conclusion that Mr Ross had no intention of creating in Mr Rixon an apprehension of imminent harmful or offensive conduct Defence against battery- forms of conduct, long held to be acceptable, is touching a person for the purpose of engaging his attention, though of course using no greater degree of physical contact than is reasonably necessary in the circumstances for that purpose. Defence against false imprisonment/wrongfully accused-Any of the people in charge of the casino, the agent of the casino operator or the casino employee who knew that a person, the subject of an exclusion order, was in the casino premises must remove the person from the casino or cause the person to be removed from the casino. These arguments were used by the Plaintiff: Assault- The appellant Mr Rixon claimed that he was assaulted by the government inspector Ross. Mr Rixon claims that the inspector grabbed him by the shoulder and spun him around while he was playing poker. He said that it hurt his shoulder and neck. Battery- The appellant Mr Rixon claimed that the inspector had grabbed him by the shoulder and spun him around. This was not acceptable to him and he felt that it violated his security. Quote from her Honour The law cannot draw the line between different degrees of violence, and therefore totally prohibits the first and lowest stage of it; every mans person being sacred, and no other having a right to meddle with it, in any the slightest manner. †. False imprisonment/ wrongfully accused- The plaintiff claimed that he was wrongfully accused and did not deserve to be imprisoned. He also claimed that was in false imprisonment and that they had no right to keep him at the casino. In what court was the case heard? Was the case heard only by a judge or a judge and jury? Why? This particular case was held in district court infront of a judge- judicial officer: Balla ADCJ. This case was only presented in front of judge and not in front of a jury because it is not a criminal case it is a civil case. State the verdict and punishment handed down. Do you think this decision was fair why? / why not? The decision made by judge Balla was that the appeal would be dimmised with cost. The trial Judge rejected Mr Rixons case in battery on the basis that the touching lacked the requisite anger or hostile attitude to be considered as battery. Therefore her Honour dismissed the appeal. The trial Judge rejected the case in assault by finding that the actions of the defendants employee lacked `the requisite intention in relation to assault. Her honour rejected Mr Rixons account of being grabbed or spun round, her Honours finding that Mr Ross placed his hand on Mr Rixons shoulder without using any degree of force and said Are you Brian Rixon? This led her to conclude that Mr Ross had no intention of creating in Mr Rixon an apprehension of imminent harmful or offensive conduct. Therefore her Honour dismissed the appeal. The trial judge rejected the case in False imprisonment and wrongfully accused. The detention of Mr Rixon was made on reasonable grounds and that no more force was used than was proper in the circumstances. Her Honour said that Mr Rixons evidence established that he was informed of the reasons for the detention and that the police were notified immediately of the detention. Mr Rixon was not detained for any longer than was reasonable to enable a police officer to attend at the casino premises. Furthermore Mr Rixon was subject to an exclusion order. By entering the premise he violated the exclusion order and was detained while the police were notified. The staffs at Star City were just following protocol. Therefore her Honour dismissed the appeal. I believe that the verdict for this case was fair as Mr Rixon was out of line and did not need to sue on such an unworthy matter. The staffs at Star City Casino were simply doing their jobs as instructed. The judge did give the matter thoughtful revision and came to an accurate decision.

At the beginning, Nick Carraway, the protagonist, gives his backstory. He recently moved into a house he rented in West Egg, which is a district in long island. It is full of â€Å"new rich† (people who recently got their money.) East Egg, however, is full of people who were born rich. The people that live in these places are the same, but different. Nick lives near a mysterious man named Jay Gatsby. He lives in a huge mansion and is always throwing awesome parties. Nick goes to a dinner with his cousin from East Egg, Daisy, and her husband Tom Buchanan. At the dinner, Nick meets Jordan Baker, a pro golfer. Tom leaves the room for a phone call. The call is from his lover, Myrtle Wilson. Jordan leaves because she has a golf tournament the next day, and Daisy and Tom suggest that Nick and Jordan get into a relationship together. Nick goes home to see Gatsby outside staring a green dock light. Later, Tom and Nick are riding a train to New York, but Tom forces Nick to get off with him to the valley of ashes. He is going to George Wilson’s garage to see Myrtle Wilson. Tom brings her and Tom to an apartment he keeps just for his affair in New York. There they have a â€Å"party† with Myrtle’s sister, Catherine, and the McKees. They discuss rumors about Gatsby and get drunk. Tom gives Myrtle a dog. Later, she starts to talk about Daisy, and Tom gets angry and tells her to stop talking about her. She continues so she breaks her nose. Later, Nick is home when one of Gatsby’s servants brings him an invitation to his party. Nick goes to the party where he sees that Jordan is also there. While there, they hear people discussing Gatsby’s background and what they have heard. They try looking for Gatsby, but run into a man reading books in Gatsby’s libra... ... sees Gatsby outside of Daisy’s house. He tells Nick that Daisy was driving and he’s waiting to see if Tom is going to hurt Daisy. The next day, before Nick goes to work, he goes to Gatsby and finds out that he was at the Buchanan’s all night and nothing happened. Nick stays to talk with Gatsby about his love for Daisy. One of Gatsby’s servants tells him he wants to drain the pool, but Gatsby intends to use it soon. Nick later explains that when Wilson found out about Myrtle’s accident, he thought the other car belonged to her lover. So he tried to find out who owns the car. He knows that Tom knows whose car it is. Later, he shows up at Gatsby’s mansion. Gatsby is in his pool, on a raft, looking at the sky, when Wilson shoots him and then shoots himself. Nick shows up and sees Gatsby dead. For the funeral, Nick tries to get people to the funeral but nobody will go.

Introduction In the past 25 years, international passenger aviation has experienced a threefold increase. It is expected that the aviation sector will continue to see similar growth over the next 25 years (Walker & Cook, 2009). Due to the rapid expansion of the aviation sector, there has been a growing concern for environmental issues in airline operations, especially in terms of energy and environmental sustainability (Agarwal, 2010). The focus on sustainability and environmental protection is due to the environmental consequences of contemporary aviation, especially the contribution of aviation to global climate change (Upham, 2003). With the recognition of the harmful effects of aviation on the environment, experts predict that â€Å"environmental factors will increasingly limit the expansion of air travel and the social benefit that it brings† (Green, 2003, p.281). Meridiana concurs that it is important to consider sustainability and environmental protection in aviation. It recognises the importance of green aviation and puts a lot of value on protecting the environment. In line with this, the company manages its activities in compliance with national and EU environmental regulations. As proof of its commitment, it has been awarded certification of its Quality System in compliance with UNI EN ISO 9001:2008 regulation for air quality. It should conduct seat sales in which the flight fare is a fraction of its original price but customers can avail of the ticket only for a limited period. For example, the seat sale gives an 80% discount on ticket prices for 50 seats in the plane and the sale will be ongoing for 3-5 days only. Meridiana should also prioritise internet/online promotions and strengthen its social media presence. The airline should improve its advertisement and tie-ups with online travel sites such as Expedia, Kayak, and Orbitz. I noticed that even though I was taking notes and looking for inferences I am guilty of making them myself. For example, my best friends’ husband is at home all the time and they struggle to pay their bills. My friend is always asking me to loan her money. I was talking to my sister about it and I told her I thought my friends’ husband was lazy and shouldn’t be relying on her to take care of him.My sister agreed and we left it at that. Later on that day my best friend called me and asked if I could help her till next payday. I said sure and asked her why her husband isn’t working. She told me he has bipolar disorder and can’t hold a job, he has tried numerous times but has difficulty concentrating. They were in the middle of applying for S. S. I and that it was a long drawn out process. He is very ashamed of it and that’s why nobody knows about it.I should of thought it through when I was talking to my sister before I made the inference that he was lazy. Eppleton Colliery essays

Eppleton Colliery essays When it closed in 1986 Eppleton Colliery was one of the oldest coal mines left in Europe. Work on a shaft at the site at Hetton Downs, in Hetton-le-Hole, was started in 1825. The mine was owned by the Hetton Coal Company, which also owned Elemore Colliery in Easington Lane. It took 8 years to finally finish this first shaft, called The Caroline pit. It took so long because soon after digging down, the miners found lots of sand and water. The work was very dangerous because the mine often caved in and flooded. Many people did not believe it was possible to have a pit there. There was 30 meters of sand and water flooded in at a rate of 1200 gallons per minute, but the Main coal seam was reached 270 metres underground on August 1st 1833. A second shaft, the Jane pit, was sunk in 1837 and reached the Busty coal seam. It was at this time that the terraced houses in Hetton Downs were built where the Eppleton miners and their families lived. A third shaft the Lindsay pit was sunk in 1874 to connect with the Hutton coal seam. Over time Eppleton Colliery changed ownership from the Hetton Coal Company to the Lambton By the end of the 19th century, Eppleton Colliery was one of the most modern in the Durham Coalfield. It employed 1100 men and boys underground and 300 on the surface. The coal seams were fairly thick and could be easily worked. The three shafts at Eppleton were ventilated by furnaces and coal fire boilers which pumped air to the underground coal faces. The daily production for coal was 3000 tons per day, making it a one of the most efficient in the country. The National Coal Board (NCB) took control of Eppleton Colliery when the pits were nationalised in 1947. The history of social welfare reflects differences in values as they relate to social responsibility in taking care of the needy. Our society has been influenced by values like Judeo-Christian humanitarianism and the economic doctrine of laissez faire. Our present social welfare structure is also influenced by these values. Our English heritage has greatly affected social welfare today. Some of the standards set in England include: indoor relief; a national policy for the poor; the provision of serving the poor by placing them in institutions; and the categorization of the poor into two basic categorizes, the worthy poor and the able-bodied poor (unworthy poor). The Elizabethan Poor Law also set precedents which include: clear government responsibility for those in need; government authority to force people to work; government enforcement of family responsibility; responsibility for carrying out programs at the local level; and strict residence requirements. In England during the late 1700’s there were other efforts that led to shaping the United States social welfare policies that address poverty. The Speenhamland Act of 1795 was one such effort. It â€Å"provided for the payment of minimum wages to workers and their families, with the government making up the difference if employers could not afford to pay all costs†. Even though it was not successful, this act set the principles of government subsidies for private employers (this was an approach promoted for in 1996 as an element of welfare reform). The words â€Å"wail† and â€Å"whale† sound identical, which means that they’re easy to mix up. Wail (Cry or Scream) The word â€Å"wail† can be either a noun or a verb. I will provide a â€Å"†¦detailed explanation of the effective strategies an organization can implement to create and maintain a conducive working relationship with unions, as well as the effective strategies a union can implement to create and maintain a conducive working relationship with management† (Ashford University). I will begin by briefly describing the role of management in an organization. Management is responsible for the smooth running of the company. Keeping employees happy on the job would be one of the duties involved. Keeping up with industry standards and always moving forward with innovation, while heeding all safety regulations and laws. Working with and not against the flow of the operation to be successful while making a profit is where management can soar. Secondly I will briefly discuss the role of a union in an organization. A basic requirement of unions is that members give up their individual rights (e.g., raises based on performance) to benefit the collective (e.g., cost of living increases to all employees). Is this equitable and fair? Well members of unions negotiate as a group with the employer and this ensures more power than if they were just alone on their own. While it has been documented that union employees make 27 percent more than nonunion workers. Ninety-two percent of union workers have job-related health coverage versus 68 percent for nonunion workers. Union workers also have a great advantage over nonunion workers in securing guaranteed pensions (howstuffworks.com). This is the bright side of union membership, so it seems that giving up rights to obtain these advantages would be sound advice. In my opinion if the union performs the duties the member/employee signed up for, then yes it would be equitable and fair to give up their rights. On the other hand if the union  performed poorly in its duties, I would consider leaving for another position elsewhere. Some of the positives that involve unions would be the capitalist ideas that make this country what it is today. Unions are there for each employee who is represented by them and protected in the work place from unfair tactics. â€Å"Capitalism is directed towards the pursuit of profits and unions are directed towards the rights of workers.† The way these opposing viewpoints can be advantageous, yet destructive, to the business community depends on the way they balance the two. A profits interest is often referred to as a carried interest. A profits interest is typically given as a reward for the performance of services (myllcagreement.com) This method serves as an incentive for partners to become more proactive in pursuing bigger and better profits thus contributing towards the companies growth (investopedia.com). Growth is essential to the success of the business and the union, without losing sight of the interests of the employee (member). Growth indicates a profit is made and a company should hold in high esteem the people who made this so. So as a company grows it should ensure the employees are happy and treated fairly. They should not lose sight of the bottom line which is the business itself: them and the employees. Unions step up to make sure the employee is treated right with fair conditions and proper raises as the company moves forward. The destructive issue could occur if the employee was not rewarded as the profits increased. An unhappy employee will make for an unsuccessful business. There are some downsides to unions. Let me first say that strikes are a big part of what could possibly be the one downside, if issues do not work for the benefit of the employee represented. Although strikes were intended to get management’s attention, â€Å"The incidence of strikes has been almost steadily decreasing, and strikes now consume a minuscule portion of total working time—in the neighborhood of one-twentieth of 1 percent in most recent years† (Sloane, 2010, pg. 4). Many times a settlement takes place which will avert a strike and this is when both sides reach a compromise. If a strike ensues only a percentage of employees’ wages are paid, if they participate in picket duty. But, â€Å"For most unionized employees who agree to strike: †¢They stop getting a paycheck. †¢Their family’s healthcare and dental benefits are suspended. †¢They are not  eligible to receive state unemployment benefits. †¢Their job can be filled with a replacement worker.  Ã¢â‚¬ ¢Their job can be impacted in the future, if there is a loss of customers during the strike† (cintasfreedomtochoose.com). Depending on the results of the strike, winning or losing could alter the reputation of the union and also of the employer, for better or worse depending on the results. Appropriate circumstances where a strike would be an appropriate bargaining tactic would be when a failure to communicate occurs and further negotiations need to happen. A total breakdown in communication is most always when strikes occur. Sometimes though strikes occur in an inappropriate manner and this is when the employee suffers. It is when this happens or when the public welfare is affected that a strike would be deemed inappropriate. There are many global major players are union run, I realistically know that we would be in a world of trouble without them, in example: AFL-CIO and the SEIU. To be honest with you I have the impression that unions such as these actually perform better on a political platform. With all the money and power there comes responsibility, and more often than not we hear about the corruption unions flex influencing (lobbying) individuals in the position to pass laws with ‘dark money’. â€Å"Dark Money? AFL-CIO accused of campaigning without disclosing† (watchdog.org). This in no way seems to be connected with the absolute values unions initially professed, which was to stand up for the worker and give strength to the small guy. Now as things have progressed, the red tape becomes likened to fly paper, very sticky. Unions favorably represent the needs of the higher ups and I give again the article in our Course Materials about the ‘Bitter Bargain’. The bigger the union size the less likely the small guy’s needs will be met, since large money/power weld negative actions. But with a small union it becomes an intimate task to please your members and therefore a more positive vibe is felt. â€Å"Selected Evidence About Globalization’s Impact on the U.S. Labor Market Effects on Overall Incomes and Wages† (dol.gov) is another issue that affects the bottom line of the globally competitive work environment. Free trade influences the profits or losses/jobs or unemployment of this country. It makes one wonder if this is not why large unions have become much like a small country with a government playing king of the hill. I will present two strategies/actions an organization can  implement to create and maintain a conducive, working relationship with unions. Employers set the pay scale for each job and two strategies/actions they implement to keep the peace with union members is to use the comparative norm strategy and the ability-to-pay (cost of living increase). There are different circumstances where it would be more appropriate for an organization to follow the comparative norm strategy to determine an employees wage rate, versus the ability-to-pay or the cost of living strategy. Depending on the industry the employee is in will be the determining factor in whether the employer has the capabilities to meet economic demands. There are classifications in the different industries, and even subgroups within the different industries. Another factor at work that divides the comparative norm would be job titles. Each place of work has a different description for job titles and they vary greatly, so in many situations a certain wage would not be appropriate for employees at different work places with the same title. Wage systems are another way that the comparative norm may not work, since the pay may be ‘by hour’, incentive systems paid individually, and group incentive systems. Benefits cannot go unnoticed and are a part of the pay system. Depending on where you live in the nation may also have an impact on the wage an employee is given (i.e. cost of living differences). Typically the minimum wage increase I have experience with would be the annual 4% cost of living wage, and this is in the American south west states. Profits made by the company you work for hold major criterion on the ability to pay a cost of living increase. The formal document in which a union claims that the employer has breached the collective  bargaining agreement and for which, arbitration is convened† (duhaime.org). The way the use of the grievance and arbitration processes and procedures can enhance the relationship between a union and management is that is can reach a position that both parties can find common ground and satisfaction. Where this same effort can be destructive is when the breakdown in trust and commitment fall into place where once the opposite was true. Monetary losses occur at this point and sometimes the union fails to properly represent the employee and resentment occurs. When â€Å"†¦confusion and uncertainty in the area of employer–employee relations† (Sloane, 2010, pg. 217) occurs, both parties lose. In conclusion, we all know that unions have their place in our society and can be run using effective strategies that have proven to work in the past and changing those strategies as new ideas surface in the workplace, effectively. There is a place for unions and people who would benefit from them. In assessing the changing complexion of the U.S. labor force two things come to mind: baby boomers and immigrants. Why, because these types of workers may find unionization attractive. New retirees and new citizens might be looking for jobs where unions have a foothold: like grocers. Do not forget the fiasco with the strikers in California who fought for 5 months and got something unwanted. â€Å"United Food and Commercial Workers’ Union†¦ The ratified contract contains no raises for the 70,000 supermarket workers it covers, but it does preserve most health benefits for current employees. However, new workers will receive lower wages and fewer benefits. Many workers said they voted for the contract reluctantly. The lengthy labor dispute took an emotional and financial toll† (Bitter Bargain). This will be copied, presumably, by fellow unions, and it leads to a running comment that unions no longer provide for the common worker as its mission statement once led its members to believe. Leaving citizens with less money in their pocket when benefits are not included on payday will erode the backbone of unions. It used to be 35% of American workers belonged to a union in 1959, now a fraction of that is true. Additionally predictions have commented that some baby boomers will exit the workforce leading to a â€Å"lower (the) overall labor force participation rate, leading to a slowdown in the growth of the labor force† (Toossi). This comes from the other side of the podium in the in the debate of how labor force will be affected. The complexion of America has changed and without changing for the better, I  fear unions will run their course, or transform into a totally new idea, without all the corruption that comes with power and money. Our subjective or personal wellbeing is usually determined by our genes, social conditions, personal choices and circumstances as well as the complex manner in which all of these interact with one another (Flowers 2002). By affecting our personality, genes influence our wellbeing. This could thus translate to such traits as neuroticism and extraversion that are all associated with a lower and higher wellbeing respectively (Keyes 2002). Since the genetic influences here are not immutable or fixed, they are frequently shaped by the environment, upbringing, general conditions of life and the personal experiences. In regard to health, most of the characteristic and qualities that are related to the wellbeing of a person are also related to the health of the individual. Thus wellbeing has been regarded as one that does play a central role in enhancing health through the direct effect in such processes as the immune system, physiology, diet, exercise, drinking, smoking and other lifestyle behavior (Michael2003). Such a approach to a sustainable health system will be a gradual process. Many of the factors that contribute to the well being of the individual are interrelated (Michael2003). The relationship between these factors are in most cases reciprocal. A good example is the observation that happier people are more likely than the depressed sad families to do better work, have more friends, and even earn higher income. The interrelation of these factors with well being are quite clear. As work offer purpose in life, unemployment is associated with a loss of income. Other factors such as being religious offer a good flow of social connections, sense of purpose, spiritual support and a moral code that eventually sums up to the wellbeing of the person (Hugh 2003). The lack of one of these factors sometime is compensated though partly by the presence of the other. It has been estimated that an average Australian rates their satisfaction and general happiness to about 75 per cent. Of late, the Australian government has stated that a growing strong economy is their main responsibility and goal. Economic growth has in the past been associated with the indicators of better health, wellbeing and a high quality of life. In this regard, it is globally accepted that money matters most as it does help people to meet their basic needs (Flowers 2002). The link between health, law and human rights. Health systems in all sectors of life can be analyzed for the impact they have on equality, human dignity and freedom as well as how effective they are in treating or preventing disease or ill health (Smart and Sanson 2005).
